General Terms and Conditions of Sale of LAJ
These terms and conditions of sale are concluded on the one hand by the company LAJ, whose registered office is located at Pont de Buis les Quimerc'h, 9 chemin de Garsagoff, with SIRET number 97848962300014, and on the other hand by any individual or legal entity wishing to make a purchase via the website lesapaisantes.com, hereinafter referred to as "the buyer".

Article 1. Purpose
These terms and conditions of sale are intended to define the contractual relationship between LAJ and the buyer, as well as the conditions applicable to any purchase made through the website lesapaisantes.com. Purchasing a product through this site implies unreserved acceptance by the buyer of these terms and conditions, which the buyer acknowledges having read prior to placing their order.

Before any transaction, the buyer declares that:

  • The purchase of products on the website lesapaisantes.com is unrelated to their professional activity and is strictly for personal use.
  • They have the legal capacity to commit to these general terms and conditions of sale.

The company LAJ reserves the right to modify these terms and conditions at any time to comply with new regulations or improve site usage. Therefore, the conditions applicable will be those in effect on the date of the order.

Article 2. Products
The products offered are those listed on the website lesapaisantes.com by LAJ, subject to availability. LAJ reserves the right to modify the product assortment at any time. Each product is presented on the website with a description of its main technical characteristics. Photographs are as accurate as possible but are not contractually binding.

Article 3. Pricing
Prices listed on the product pages of the online catalogue are in Euros (€), inclusive of all taxes (VAT included), based on the VAT rate applicable on the order date. Any change in the VAT rate may be reflected in the product prices. LAJ reserves the right to modify its prices at any time, but the price listed in the catalogue on the order date will be the only one applicable to the buyer. Prices do not include delivery charges, which are added to the product price based on the total order amount.

Article 4. Orders and Payment Methods
Before placing an order, the buyer must create an account on the website lesapaisantes.com. The account creation section is directly accessible from the homepage.

  • Bank Transfer Payments: The buyer selects the products to order in their "basket," adjusts quantities or references as needed, and verifies or updates the delivery address. Delivery charges and carrier details are then provided. Once the order is confirmed, the buyer must initiate the bank transfer to OHBAYASHI Haruka using the provided bank details. Orders will be processed after the transfer is received.

  • Secure Payment via PayPal or Credit Card: Similar steps as above, except the buyer selects "PayPal" for payment and is redirected to a secure interface to complete payment via PayPal or credit card. Payments are irrevocable and secure.

Article 5. Ownership Reservation
LAJ retains full ownership of the sold products until the total price (including fees and taxes) is paid.

Article 6. Withdrawal
In accordance with Article L121-20 of the French Consumer Code, buyers have a 14-day withdrawal period from the delivery date to return the product for exchange or refund, excluding return costs.

Article 7. Delivery
Deliveries are made to the address specified on the order form and are limited to the agreed geographical area. Shipments are handled by La Poste via COLISSIMO with tracking. Risks during transport transfer to the buyer once items leave LAJ's premises.

Article 8. Warranty
All products from LAJ are covered by the legal warranty under Articles 1641 and subsequent of the French Civil Code. Claims for non-conforming products must be made within three days of delivery.

Article 9. Liability
LAJ is only bound by an obligation of means in the distance selling process and cannot be held liable for damages resulting from internet-related issues.

Article 10. Intellectual Property
All elements of lesapaisantes.com remain the exclusive intellectual property of LAJ.

Article 11. Personal Data
LAJ commits to maintaining the confidentiality of buyer-provided information under French law n°78-17 of January 6, 1978. Buyers may request access, modification, or deletion of their data at any time.

Article 12. Dispute Resolution
These terms and conditions are governed by French law. Any disputes will be under the jurisdiction of the court in Quimper.
